Terms & Conditions

We reserve the right to change or alter any of the terms and conditions without notice, however we will undertake to inform pupils of any changes as soon as possible.

The following terms and conditions represent the basis upon which driving lessons and courses are offered to you by your Instructor. The contract for driving tuition is solely between you and your Instructor. Your Instructor is a self-employed franchisee and operates under franchise from WAM Driving School and has agreed to be bound by the following terms and conditions.

Driving Licence

Tuition is only available to persons who hold a current, valid driving licence; provisional, full or international, which must be produced on or in advance of their first lesson.

Eyesight and fitness to drive

You must be able to read (with glasses or contact lenses, if necessary) a car number plate from a distance of 20 metres.

You must be fit to drive with regard to legal and medical requirements. The Instructor reserves the right to terminate a lesson if they have reason to believe that the pupil is under the influence of alcohol or drugs.

Lessons

You and your Instructor are responsible for agreeing all matters relating to the timing, location and duration of individual lessons.

The Instructor will determine a location for practical lessons which ensures both the pupil’s and public safety; the Instructor may need to drive the pupil to and from the lesson location; this journey time forms part of the lesson as paid for.

Cancellation of Lessons

If you or your Instructor wish to cancel a lesson a minimum of 48 hours prior notice should be given. If your Instructor cancels a lesson without giving this minimum period of notice your Instructor shall rearrange the lesson. Cancellations made by you must be made directly between you and your Instructor.

If you do not give at least 48 hours’ notice of cancellation you will be charged for the lesson(s) concerned in full.

In the event of you having booked your driving test, the Driver and Vehicle Standards Agency (DVSA) requires you to give three clear working days to cancel your test. This may mean that you may lose your DVSA test fee if your Instructor says you’re not ready for your test within this three-day notice period.

Payments and Lesson Bookings

You must pay your Instructor for any tuition at least 48 hours before the start of the lesson. Payment by any method, you should obtain a receipt.

Refund Policy

You are entitled to cancel your prepaid tuition at any time (for the provisions relating to the cancellation of individual lessons please see the Cancellation of Lessons). If you have not taken any lesson(s) at the time of cancellation you will be entitled to a full refund from your Instructor of any amounts paid, subject to the below.

Refund of partial block booking will be made pro rata on any lessons not taken.

If an outstanding balance is not used for lessons or refunded within 3 months, this will then be non-refundable.

It is imperative that your lessons and payments are recorded and signed for and kept accurate and up to date.

Driving Tests

While your Instructor will make every effort to ensure that the vehicle supplied for test will be fully road worthy and comply with all legal requirements at the start of the test, they cannot be held responsible for vehicle failure that occurs during the test and is not liable for consequential loss. Your Instructor cannot be held responsible for test appointments cancelled by the DSA due to bad weather, sickness, staff shortages or other reasons. Such cancellations are beyond the control of your Instructor and therefore the lesson fee and 'use of car' fee for the booked period will be charged. Your Instructor will advise you about claiming compensation from the DSA.

Code of Conduct

Your Instructor agrees to abide by the conditions of the approved driving instructor code of practice. Any complaint will be dealt with in accordance with the ADI code of practice.

General Conduct

All Instructors are bound by the ADI code of practice. Your Instructor will be courteous, polite, tidy and punctual. They will also behave in a professional and ethical manner at all times. Your Instructor’s car will be well maintained, clean and tidy. All cars used are fitted with dual-controls, fully insured for driving tuition and Instructors will not smoke in the car while giving tuition, nor will they use your lesson time for any other form of business, personal or otherwise.
